Terms of Service

1. Acceptance of Terms
By purchasing, downloading, or using synthetic patient datasets from PatientDatasets.com ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. License Grant
2.1 Single-User License
Each purchase grants a license to one individual or one academic course section. The license is non-transferable and non-exclusive.
2.2 Permitted Uses
- Personal research and education
- Academic coursework and assignments
- Published research (with proper citation)
- Healthcare AI model training and validation
- Software testing and development
2.3 Academic Course Licenses
Course licenses permit distribution to enrolled students ONLY for the licensed semester. Students may not retain or redistribute datasets after course completion unless they have purchased an individual license.
3. Restrictions and Prohibitions
3.1 NO REDISTRIBUTION
Datasets may NOT be:
- Shared with others who have not purchased a license
- Uploaded to public repositories (GitHub, Kaggle, etc.) without explicit written permission
- Published in supplementary materials of research papers (cite the source instead)
- Included in commercial products or services without an enterprise license
- Resold or sublicensed to third parties
3.2 Watermarking and Monitoring
All datasets contain invisible watermarks for license verification. We actively monitor public repositories and file-sharing platforms for unauthorized redistribution.
Removal or circumvention of watermarks is strictly prohibited.
3.3 Enforcement
Violations result in:
- Immediate license revocation
- DMCA takedown notices to hosting platforms
- Notification to academic institutions (for course licenses)
- Blacklisting from future purchases
- Legal action for commercial misuse
4. Citation Requirements
Use of datasets in published research, presentations, or public reports requires citation:
Include the version number and access date in your citation.
5. Nature of Data
5.1 100% Synthetic
All patient records are 100% synthetic — generated by AI and not derived from any real patient data. Names, demographics, diagnoses, medications, and all other fields are fictional.
5.2 HIPAA Does Not Apply
Because no real Protected Health Information (PHI) exists in these datasets, HIPAA's Privacy Rule, Security Rule, and Breach Notification Rule do not apply. No de-identification is required. No Business Associate Agreements (BAAs) are needed.
5.3 No IRB Approval Required
Synthetic data does not involve human subjects. Institutional Review Board (IRB) approval is not required for use in research or education.
6. Warranty Disclaimer
THE SERVICE AND ALL DATASETS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:
- Data will be error-free or clinically perfect
- Data will meet your specific requirements
- Use of data will result in successful research outcomes
- Data distributions exactly match real-world populations (though we strive for statistical realism)
7. Limitation of Liability
IN NO EVENT SHALL PATIENTDATASETS.COM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
Our total liability shall not exceed the amount you paid for the dataset.
8. Refund Policy
Because this is a digital product delivered immediately upon purchase, all sales are final.
We offer a free 3-record sample so you can evaluate data quality before purchasing. If you experience technical issues with your download, contact support@patientdatasets.com.
9. Updates and Versioning
Datasets are versioned. One-time purchases grant access to the version purchased at the time of sale.
Annual updates (new ICD-10 codes, updated drug formulary, new scenarios) are available through Living Dataset Subscriptions or separate repurchase.
10. Termination
We reserve the right to terminate your license immediately upon breach of these Terms. Upon termination, you must delete all copies of the datasets and cease all use.
11. Governing Law
These Terms are governed by the laws of the United States. Any disputes shall be resolved in courts located in [Your Jurisdiction].
12. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. Check this page periodically for updates.
